These terms are an agreement between you and ClickTree for using the ClickTree service. By creating an account, accepting an invite or using ClickTree, you agree to them. If you use ClickTree for an organisation, you agree on its behalf and confirm you’re allowed to.
About these terms
ClickTree is based in England and Wales. Our Privacy Policy explains how we handle personal data and forms part of these terms.
ClickTree is intended for business and professional use. If you’re a consumer, nothing in these terms affects your legal rights.
The service
ClickTree lets you build navigation trees, write tasks, share a study link with participants, and analyse the results, including success rates, paths, pietrees, findings, PDF reports and CSV exports. Features depend on your plan.
The findings ClickTree shows are generated by fixed rules from your results. They’re a guide to support your judgement, not professional advice, and you’re responsible for the decisions you make from them.
Accounts and workspaces
You must be 18 or over and give accurate details.
Keep your password safe, and tell us straight away if you think someone else has used your account. You’re responsible for activity in your account.
Each account belongs to one person. Don’t share sign-ins; invite teammates instead (Enterprise plan).
Workspace owners control who can access a workspace and can add or remove members. Everyone in a workspace can see and edit its studies and results.
Plans, billing and cancelling
Free is free with the limits shown on our pricing. We may change the Free plan’s limits with reasonable notice.
Paid plans are billed in advance, monthly or annually depending on the plan you choose, and renew automatically until cancelled. Prices are in pounds sterling and include VAT where it applies. Your invoices show the VAT amount.
Cancelling: you can cancel at any time. Your plan stays active until the end of the period you’ve paid for, then won’t renew. We don’t give refunds for partial periods unless the law requires it.
Plan limits: when a workspace reaches a limit, such as responses per month, new participants see that the study is full until the limit resets or you upgrade.
Price changes: we’ll give at least 30 days’ notice of a price change, and it applies from your next renewal.
Late payment: if a payment fails and isn’t resolved, we may move your workspace to the Free plan. Your data stays, but paid features and limits stop applying.
Acceptable use
You must not use ClickTree to:
break the law, or collect personal data without a lawful basis and proper notice to the people concerned
collect special category data, such as health, religion, ethnicity, sexuality or political views, or data about children, unless you have a clear lawful basis and appropriate safeguards
send spam, phishing, malware or misleading content to participants
attempt to access other workspaces, get around plan limits or security, overload the service, or scrape or reverse-engineer it
resell ClickTree, or use it to build a competing product
Your content
You own what you put into ClickTree: your trees, tasks, client details, logos and study results. You give us permission to host, process and display that content only as needed to provide ClickTree to you, including generating reports and exports.
You confirm you have the right to use any content you upload, including client logos and brand colours. The same applies to web pages you ask ClickTree to screenshot for a study: only capture pages you’re allowed to use for research. You can export results as CSV at any time while your account is open.
Running studies with participants
When you run a study, you are responsible for:
telling participants who you are, what you’re collecting and why, and how long you’ll keep it, for example in the study’s welcome message
having a lawful basis for any personal details you ask for, such as name, email or gender, and only asking for what you need
dealing with participants’ requests about their data, with our help where needed
deleting responses you no longer need
How we process study data for you
For personal data in your studies, you are the controller and we are your processor. These terms form a data processing agreement under Article 28 of the UK GDPR and EU GDPR. We will:
process the data only to provide ClickTree and on your documented instructions, which are these terms and your use of the product
make sure our staff and providers are bound by confidentiality
keep the data secure, including encryption and separating each workspace at the database level
use only the sub-processors listed in our Privacy Policy, under written terms that protect the data. We’ll give notice of new sub-processors, and you may object.
help you respond to participants’ rights requests, and with security, breach notification and data protection impact assessments, as reasonably required
tell you without undue delay if we become aware of a personal data breach affecting your data
delete your study data when you delete it, or after your account closes, unless the law requires us to keep it
make available the information reasonably needed to show we meet these obligations
Data is hosted in the EU. Where a provider processes data outside the UK or EU, appropriate safeguards are in place, as described in the Privacy Policy.
Our intellectual property
ClickTree’s software, design and brand belong to us. While you use the service, you have a non-exclusive, non-transferable right to use it under these terms. If you send us feedback or ideas, we may use them without obligation to you.
Availability and changes
We work hard to keep ClickTree available and secure, but we can’t promise it will always be uninterrupted or error-free. We may improve, change or remove features. If we remove something significant from a paid plan, we’ll give notice, and you can cancel.
Liability
Nothing in these terms limits liability that can’t legally be limited, such as for death or personal injury caused by negligence, or for fraud.
We aren’t liable for indirect or consequential losses, or for loss of profit, revenue, business or goodwill.
Our total liability to you in any 12-month period is limited to the amount you paid us for ClickTree in that period, or £100 if greater.
You are responsible for claims arising from your content, your studies, or your breach of these terms or of data protection law.
Suspension and ending
You can stop using ClickTree at any time, and can ask us to close your account through the contact form. We may suspend or close an account that seriously or repeatedly breaks these terms, puts the service or others at risk, or where the law requires it. Where reasonable, we’ll warn you first and give you a chance to export your data.
When an account closes, we delete its data as described in the Privacy Policy. Sections that by their nature should continue, such as liability, will continue.
General
Changes: we may update these terms. For important changes we’ll give reasonable notice. Continuing to use ClickTree after changes take effect means you accept them.
Transfer: we may transfer these terms to a company that takes over ClickTree.
No waiver: if we don’t enforce a term straight away, we can still enforce it later. If any part of these terms can’t be enforced, the rest still applies.
Law: these terms are governed by the law of England and Wales, and its courts have jurisdiction.
